  List of Hague Conventional Countries (HCC) accross the World are under,
Ministry of External Affairs-MEA Apostille is the simplified Certification of Public Documents (including Notarization, for their International use in all Nations that have joined the Apostille Section of the Hague Convention. Signatory Countries have agreed under the Apostille Section of the Hague Convention to recognize Public Documents Certified by the “Apostille”. This Certification ensures that Public Documents are valid within the Country where the Document was originally issued or Notarized. The main function of the Apostille is to certify the Authenticity of the Signature on the Document (ie: State Registrar, County Clerk, Judge, Magistrate, Sub Divisional Magistrate (SDM), Vital Records Officer or Notary Public etc). The Apostille also certifies the capacity in which the person signing the Document acted and the Identity of any stamp or seal affixed to the Document. The Apostille is a one page Document imprinted with the Great Seal of a State and includes the facsimile Signature of the individual issuing the Certificate. There are currently over 94 member states of the Hague convention and in the future, many other Countries will join the Apostille Section of the Hague Convention to be able to recognize the Apostille for the International Legalization of Documents. The Apostille is applied only to Public Documents, signed by an Authority or Official connected with a Court or Tribunal of the State (including Documents issued by an Administrative, Constitutional or Ecclesiastical Court or Tribunal, a Public Prosecutor, a Clerk or a Process Server); Administrative Documents, Notarial acts and Official Certificates which are placed on Documents signed by persons in their private capacity, such as Official Certificates recording the Registration of a Document or the fact that it was in existence on a certain date and Official and Notarial Authentications of Signatures. On reading of the following process and details, please keep in mind that the HRD and Higher Education Department never Attest non-educational Certificates or Commercial / Export Documents and these Certificates or Documents will be Attested by other Departments like General Administrative Department (GAD), Regional Attestation Center (RAC), Home Department, Sub Divisional Magistrate (SDM), Chambers of Commerce, Ministry of Foreign Affairs (MoFA), Ministry of External Affairs (MEA) etc. The under mentioned process of Attestation is in general and practices in India presently.

From the viewpoint of Certificate Attestation, Apostille or Embassy Legalization, the Certificates could be divided into three types and these are Educational Certificates, Non Educational Certificates and Commercial Documents. All these above mentioned three types of Indian Certificates could be Attested, Apostilled or Legalized from any foreign Embassy or Consulate present in Delhi, Mumbai, Chennai or Kolkata: India. To reach the final Apostille or Legalization of the Certificate, it has to pass through some mandatory primary Attestation process from various Authorized Indian Authority. The Certificate Attestation for primary, secondary and tertiary depends upon the purpose of the Attestation and the Country where it will be used. The Attestation Authorities of Certificates are General Administrative Department (GAD), Regional Attestation Center (RAC), Home Department, Sub Divisional Magistrate (SDM), Human Resource Department (HRD), Ministry of Higher Education, Ministry of Foreign Affairs (MoFA), Ministry of External Affairs (MEA) etc. The detail description of Certificate MEA Apostille Attestation and Embassy Legalization are as under,

The term Apostille has derived from French language and it could be defined as: The Hague Convention Abolishing the requirement for Legalization for Foreign Public Documents (FPD), the Apostille convention.

The Apostille agreement is an International pact summarized by the Hague Conference on Private International Law. It specifies the modalities through which a document issued in one of the signatory Countries can be certified for legal purposes in all the other signatory Countries. Such a certification is called an Apostille (It is a French word, and its meaning is Certification). It is an international Certification equivalent to a Notarization in domestic law.

In India, Apostille Attestation is done by the Competent Authorities designated by the Government of India which is party to the convention. A list of these authorities is maintained by the Hague Conference on Private International Law. Examples of designated authorities for Apostille Attestation are Embassies, Ministries, Courts or Local Governments. For example, in India, the Ministry of External Affairs (MEA) or the Ministry of Foreign Affairs (MoFA) is the competent Authority to affix Apostille Attestation on the Certificate.

To be eligible for an Apostille Attestation, a Certificate firstly must be certified by an officer recognized by the Ministry of External Affairs (MEA), Government of India. Once the designated officer or authority has certified the Certificate then the Apostille Attestation will be done by the Ministry of External Affairs (MEA) or Ministry of Foreing Affairs (MoFA), New Delh, Mumbai, Chennai, Kolkata: India. For example, in India, if a Certificate has issued in Agra, Uttar Pradesh) then firstly it will be Attested by the Human Resource Department (HRD), General Administrative Department (GAD) / Regional Attestation Department (RAC) or Home Department of Uttar Pradesh. After completion of the first Attestation process finally the Certificate will be Apostilled by the Ministry of External Affairs (MEA) or Ministry of Foreing Affairs (MoFA), New Delhi, Mumbai, Chennai, Kolkata: India.

In India, the Apostille Attestation itself is a printed form/sticker consisting of 11 standard fields. On the top of the Apostille sticker is the text written as “APOSTILLE”, under which the text “Convention de La Haye du 5 octobre 1961” is written (in English it is: Hague Convention of 5 October 1961). The fields contains the following details,

The Apostille attestation form / sticker will be placed on the back side of the original Certificate itself.

Any educational or non-educational Certificate could be Apostilled from Ministry of External Affairs (MEA) or Ministry of Foreign Affairs (MoFA), New Delhi, Mumbai, Chennai, Kolkata: India after the attestation of the competent Government organization designated by the Government of India. The Governmental organizations are Human Resource Development (HRD), General Administrative Department (GAD), Regional Apostille Center (RAC), Higher Education Department, Home Department, etc. and the designated signatory may be the Section Officer, Deputy Commissioner, Commissioner, Magistrate, Sub Divisional Magistrate, Resident Commissioner, Chief Secretary, Joint Secretary, Assistant Secretary, Director, Deputy Director etc. Once the Certificate has attested from the designated authority in India then this certificate will be Apostilled by Ministry of External Affairs (MEA) or Ministry of foreign Affairs (MoFA), Government of India. The above mentioned Certificate Apostilization process is applicable if the destination country is a Hague Conventional Country (HCC).

Apart from the above said Certificate Apostille process, there is an alternate Certificate Apostille / Apostilization process is also practiced in India, and this process of Certificate Apostille is in use in maximum level. In this process the Certificate issued from anywhere in India, firstly will be attested from Sub Divisional Magistrate (SDM), New Delhi after that the Certificate will be Apostilled by Ministry of External Affairs (MEA) or Ministry of Foreign Affairs (MoFA), Delhi, Mumbai, Chennai, Kolkata: India. The said process is an alternate, genuine and acceptable process for maximum number of Hague Conventional Countries (HCC) across the globe. In the same time, some Countries are very particular for Certificate Apostille / Apostilization process and they require the state level Attestation / Authentication (GAD, HRD, Home Department, Higher Education Department etc) on the Certificate prior to the Apostille from Ministry of External Affairs (MEA) or Ministry of Foreign Affairs (MoFA), New Delhi, Mumbai, Chennai, Kolkata: India.

Note:

All the above said Certificate Apostille process, the Attestation from Notary is mandatorily require. The Attestation from Notary could be completed from anywhere in India for Indian Certificates. But some country requires the Notarization from the state of issuance of the Certificate. All the Attestation and Apostille process will be done on the original Certificate. Some Country requires the translation copy of the Apostilled Certificate issued in India in English language to their own country’s languages. The translation requirement could vary from Country to Country, as some country requires the Translated Certificate after the Apostille process and on the other hand some Country requires the Translated Certificate to be Apostilled. Also some country requires both the original as well as Translated Certificate to be Apostilled. Some Country requires the fresh / reissued Apostilled Certificate. In that case the issuance of the Certificate and the complete Apostilization will be within six months. To attest or Apostille the Certificate from the above said various departments, there is no requirement of presence of the Certificate holder or their relatives.
